1. Website Presentation

Pierre Gagnaire is a restaurant located at 6 rue Balzac - 75008 Paris, managed by its Chef, Pierre Gagnaire (hereinafter "the Restaurant").

Tiptoque offers the products of the Pierre Gagnaire restaurant for sale via its website https://pierregagnaire.com (hereinafter the "Website"). The Website is open to all internet users.

The Website is published by TIPTOQUE, a simplified joint-stock company (société par actions simplifiée), with its registered office at 1 rue de Stockholm, 75008 Paris, registered with the Paris Trade and Companies Register under number 81346414600030.

2. Applicability and Enforceability of these Terms and Conditions of Sale to the Customer

2.1 All orders placed on the Website are subject to these terms and conditions of sale (hereinafter the "Terms and Conditions").

2.2 The customer declares to be a natural person, at least 18 years of age, and to have the legal capacity or parental authorization to place an order on the website (hereinafter "the Customer").
In the case of orders for alcoholic beverages, Tiptoque reserves the right to ask the customer to provide proof of age and to cancel the order if it has reason to believe that the customer is a minor.

The Customer declares to be acting for their personal use and agrees not to resell the products, in whole or in part.

2.3 These Terms and Conditions are binding on the Customer, who acknowledges, by checking the box provided for this purpose, having read and accepted them before placing an order.

The Terms and Conditions applicable to and binding on the Customer will be those in effect at the time the Customer's order is validated by the Website.

3. Products

3.1 Each product offered on the Website is accompanied by a descriptive text provided by the Restaurant and one or more photos allowing the Customer to learn, before placing a final order, the essential characteristics of the product, in accordance with the provisions of Article L.111-1 of the French Consumer Code and the regulations on non-prepackaged foodstuffs.

This information is intended, without being exhaustive, to inform the Customer as fully as possible about the essential characteristics of the products and, in particular, any potential allergens, in accordance with Article R. 112-13 of the French Consumer Code.

The restaurant reserves the right to modify the contents of the dishes at any time.

The photographs illustrating the products are not contractual documents.

3.2 The products comply with the applicable regulations concerning the safety and health of persons, fair business practices, and consumer protection at the time they are placed on the market.

3.3 Products are offered and delivered subject to availability.

If a product is unavailable, the Customer will be notified by email. A replacement product will be offered, or the Customer will be refunded and the order canceled.

No cancellation compensation (other than a full refund) will be provided.

3.4 If necessary, products are delivered with storage, reheating, and serving instructions. If you have any questions, please contact the restaurant by phone, email, or via the Website.

4. Sale Price

4.1 The prices listed on the Website are in euros, inclusive of all taxes, for each product offered for sale. Delivery and shipping costs are indicated before order confirmation and charged separately.

4.2 The total amount due by the Customer is shown on the order confirmation page.

4.3 Tiptoque reserves the right to modify its prices at any time, while guaranteeing the Customer the application of the price in effect on the day of the order.

4.4 The price is due in full upon confirmation of the order.

5. Casserole Dishes - Ceramic Box - Deposit - Return of Reusable Dishes

Tiptoque offers the ultimate experience of quality delivered food. Chef-prepared dishes are delivered in cast iron casserole dishes, ready to reheat, or in a box containing ceramic dishes.

The Customer will be asked to provide a credit card authorization of €180 as a deposit before confirming the order. This deposit will only be charged if the Customer decides not to return the casserole dish or reusable tableware within 7 days and to keep the casserole dish.

The tableware can be returned directly by the Customer to the restaurant in question or via the delivery service provider, who will collect the casserole dish from the delivery location and then return it to the restaurant.

6. Gift Cards

Tiptoque also offers gift cards that allow the cardholder to order products on the website.
